The enforcement of Australian federal anti-discrimination laws has encountered constitutional limitations. Because federal tribunals are unable to make binding decisions, in 2000 enforcement of federal discrimination matters was moved from a tribunal (the Human Rights and Equal Opportunity Commission) to the federal courts. The study examines how the move from a specialist tribunal to the federal courts affected enforcement of federal anti-discrimination law. Drawing on statistical data, analysis of reported cases and interviews with parties and their advisors under both the 'old' and 'new' systems, it investigates the impact of the change in terms of: specialist versus generalist decision-making relatively informal versus formal procedures a regime in which each party bears their own costs versus one in which the loser pays the winner's costs The study traces the impact of these changes on the decisions made by complainants about whether (and where) to bring a complaint, whether to settle their cases or proceed to litigation, and on decisions made by respondents about whether to defend or settle a case. The enforcement process in federal discrimination matters was found to erect significant barriers to individuals seeking to pursue their claims in this area.
2010
Perpustakaan Kuala Lumpur
ISBN 9781921113048
English legal system, 2009-2010ent://SD_ILS/0/SD_ILS:1683642025-12-09T23:33:58Z2025-12-09T23:33:58ZSlapper, Gary. Kelly, David.
2009
Perpustakaan Kuala Lumpur
ISBN 9780415480321
Defending the right to a home : the power of anti-poverty lawyersent://SD_ILS/0/SD_ILS:582612025-12-09T23:33:58Z2025-12-09T23:33:58ZHarris, Beth
2004
Perpustakaan Kuala Lumpur
ISBN 9780754623908
Human rights in islam : the modern perspective (vol.1)ent://SD_ILS/0/SD_ILS:589102025-12-09T23:33:58Z2025-12-09T23:33:58Z2003
Perpustakaan Kuala Lumpur
ISBN 9788126113804
Human rights in islam : the modern perspective (vol.2)ent://SD_ILS/0/SD_ILS:589112025-12-09T23:33:58Z2025-12-09T23:33:58Z2003
Perpustakaan Kuala Lumpur
ISBN 9788126113804
Akta suruhanjaya hak asasi manusia 1999 (akta 597) & human rights commission of malaysia act 1999 (act 597)(hingga 20hb 2003)ent://SD_ILS/0/SD_ILS:860152025-12-09T23:33:58Z2025-12-09T23:33:58Z2003
Perpustakaan Jabatan
ISBN 9789678910910
Freedom : A photographic history of the African American struggleent://SD_ILS/0/SD_ILS:374872025-12-09T23:33:58Z2025-12-09T23:33:58ZMarable, Manning Mullings, Leith
2002
Perpustakaan Kuala Lumpur, Cawangan Setiawangsa
ISBN 9780714842707
Democracy and national pluralisment://SD_ILS/0/SD_ILS:162652025-12-09T23:33:58Z2025-12-09T23:33:58Z2001
Perpustakaan Kuala Lumpur
ISBN 9780415255776
Akta Suruhanjaya Hak Asasi Manusia Malaysia 1999 (Akta 597) & Human Rights Commission of Malaysia Act 1999 (Act 597) - hingga 25 hb Septermber 2000ent://SD_ILS/0/SD_ILS:44022025-12-09T23:33:58Z2025-12-09T23:33:58Z2000
Perpustakaan Kuala Lumpur
ISBN 9789678910910
